All artwork, illustrations, designs, graphics, logos, and visual content created, sold, or displayed by okanmibyraw are original works and are protected under UK copyright law and international intellectual property laws.
Any copying, reproduction, distribution, modification, resale, or commercial use of our artwork or products without express written permission is strictly prohibited. This includes recreating designs, producing similar artwork, digital use, NFTs, social media branding, or resale in any form.
Resale of okanmibyraw products for commercial purposes is not permitted. Breach of this section may result in legal action, order cancellation, and permanent refusal of service.
2. ELIGIBILITY & WEBSITE USE
By using this website, you confirm that you are legally capable of entering into a binding contract. You agree not to use the website for fraudulent, abusive, or unlawful purposes. We reserve the right to restrict or terminate access where misuse or abuse is suspected.
3. PRODUCTS, DESCRIPTIONS & AVAILABILITY
All products are subject to availability. We reserve the right to limit quantities, discontinue products, or update product descriptions at any time. Product images are provided for reference only, and slight variations in colour or appearance may occur due to screen settings or production processes.
4. ORDERS, ACCEPTANCE & PAYMENT
All orders are subject to acceptance. We reserve the right to refuse or cancel orders at our discretion, including where fraud, abuse, incorrect pricing, or policy violations are suspected.
Payment must be completed in full at checkout. An order is not confirmed until payment has been successfully processed. Prices do not include customs duties, import taxes, or international fees.
5. PRE-ORDERS
Certain items are sold as pre-orders and require extended processing time before dispatch. Estimated delivery timeframes are provided at the point of purchase and are not guaranteed.
By placing a pre-order, you acknowledge and accept the extended timeframe. Pre-orders may not be cancelled once production has begun, except where required by law.
6. SHIPPING & DELIVERY CONFIRMATION
Shipping timeframes are estimates only. Once an order has been dispatched, responsibility for delivery passes to the courier.
An order is considered successfully delivered when the courier confirms delivery to the address provided at checkout. This includes deliveries marked as delivered, left in a safe place, or delivered to neighbours where applicable.
We are not responsible for delays, loss, or non-delivery caused by incorrect or incomplete addresses provided by the customer.
7. INTERNATIONAL ORDERS & CUSTOMS CHARGES
Customers placing international orders are solely responsible for all customs duties, import taxes, VAT, and handling fees imposed by their country. These charges are not included in the product or shipping price.
Orders refused or returned due to unpaid customs charges are not eligible for refunds. This aligns with international shipping and payment processor policies.
8. RETURNS, EXCHANGES & REFUNDS
Our Returns & Refunds Policy forms part of these Terms of Service. Refunds are not offered as standard. Size exchanges are subject to approval, stock availability, and compliance with return conditions.
Returned items must be unworn, unused, and in original condition. Returns sent without prior approval may be refused.
9. NON-DELIVERY, LOST OR DAMAGED CLAIMS
All orders are shipped with tracking. Claims of non-delivery are assessed using courier tracking information and delivery confirmation.
Where an item is marked as delivered by the courier, it will be treated as successfully delivered for dispute and chargeback purposes. Refunds or replacements are issued at our discretion following investigation.
Damage claims must be reported within 48 hours of delivery with photographic evidence. Claims submitted outside this timeframe may be rejected.
Customers must contact us directly to attempt resolution before initiating a chargeback or payment dispute.
Where a chargeback is raised, okanmibyraw reserves the right to submit all relevant evidence to Shopify Payments, Stripe, PayPal, or other processors. This evidence may include order confirmation, delivery confirmation, tracking data, IP address logs, and communication records.
Fraudulent disputes or abuse of payment systems may result in permanent refusal of service and further action where necessary.
11. LIMITATION OF LIABILITY
To the maximum extent permitted by law, okanmibyraw is not liable for indirect, incidental, or consequential losses arising from the use of our website or products. Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under UK law.
